🚨In a historic decision, the Colorado Supreme Court ruled that former President Donald Trump is not an eligible presidential candidate because of the 14th Amendment’s “insurrectionist ban.” The ruling was 4-3 and will be placed on hold pending appeal until January 4.
In a lengthy ruling ordering the Colorado Secretary of State to exclude Trump from the state’s Republican primary ballot, the justices reversed a Denver district judge’s finding last month that Section 3 of the 14th Amendment — which disqualifies people who have engaged in insurrection against the Constitution after having taken an oath to support it from holding office — did not apply to the presidency.
“A majority of the court holds that President Trump is disqualified from holding the office of president under Section Three of the Fourteenth Amendment to the United States Constitution,” the court wrote. “We do not reach these conclusions lightly,” the statement continued. “We are mindful of the magnitude and weight of the questions now before us. We are likewise mindful of our solemn duty to apply the law, without fear or favor, and without being swayed by public reaction to the decisions that the law mandates we reach.”
The decision is certain to be appealed to the US Supreme Court, but it will be up to the justices to decide whether or take the case.

🚨Maine’s Democratic secretary of state on Thursday removed former President Donald Trump from the state’s presidential primary ballot under the Constitution’s insurrection clause, becoming the first election official to take action unilaterally as the U.S. Supreme Court is poised to decide whether Trump remains eligible to continue his campaign.
Per @apnews reporting, the decision by Maine Secretary of State Shenna Bellows (D) is sure to be appealed. The Colorado Supreme Court last week found Trump could not appear on the ballot in that state, and the Colorado Republican Party has asked the U.S. Supreme Court to review the case. The nation’s high court could resolve for all states whether Trump can run again.
So far, only Colorado and Maine have sided with those challenging his ability to run again. The Colorado court has put its 4-3 decision on hold while the U.S. Supreme Court considers whether to take the case. So, for the time being, his name is slated to appear on the primary ballot there.
This is a developing story with more updates to come.
I had the privilege of listening to one of the most hauntingly beautiful pieces of music ever written at the @nypianosociety last night. John Williams wrote the theme for Schindler’s List 30 years ago. It was played exquisitely by @zuillbailey on a cello that was built in 1693! A jury awarded $148 million in damages on Friday to two former Georgia election workers, Ruby Freeman and Shaye Moss, who sued Rudy Giuliani for defamation over lies he spread about them in 2020.
Per @nytimes reporting,the jury awarded Ms. Freeman and Ms. Moss a combined $75 million in punitive damages. It also ordered Mr. Giuliani to pay compensatory damages of $16.2 million to Ms. Freeman and $16.9 million to Ms. Moss, as well as $20 million to each of them for emotional suffering.
Over hours of emotional testimony, Ms. Freeman and Ms. Moss described how their lives had been completely upended after Dec. 3, 2020, when Mr. Giuliani first suggested that they had engaged in election fraud to tilt the result against Mr. Trump in Georgia, a critical swing state.
The women, who are Black and are mother and daughter, were soon flooded with expletive-laden phone calls and messages, threats and racist attacks, they testified. People said they should be hanged for treason or lynched; others told them they fantasized about hearing the sound of their necks snapping.
Mr. Giuliani did not testify at the trial. His lawyer, Joseph Sibley IV, told the jury that his client, the former New York mayor and federal prosecutor, should not be held responsible for abuse directed to Ms. Freeman and Ms. Moss by others.

🚨 The Supreme Court on Friday rejected a request by special counsel Jack Smith to fast-track arguments on whether Donald Trump has any immunity from federal prosecution for alleged crimes he committed while in office – a move that will likely delay his trial.
Per @cnn reporting, the court did not explain its reasoning and there were no noted dissents.
The court’s decision is a major blow to Smith, who made an extraordinary gamble when he asked the justices to take the rare step of skipping a federal appeals court and quickly deciding a fundamental issue in his election subversion criminal case against Trump.
Both sides will still have the option of appealing an eventual ruling by the DC Circuit Court of Appeals up to the high court, but the court’s move is a major victory for Trump, whose strategy of delay in the criminal case included mounting a protracted fight over the immunity question, which must be settled before his case goes to trial.
An expedited review of the issue is already underway at the DC Circuit, which has scheduled oral arguments for January 9. The election subversion trial is currently set to begin in March.
🚨 A shooting in downtown Prague killed at least 11 people, including the shooter, and injured about 30 others, Czech police and the city’s rescue service said Thursday.
According to @apnews reporting, police gave no details about the victims or the circumstances of the gunfire in the Czech Republic’s capital. They said officers were deployed due to a shooting at a school in Jan Palach Square.
Prime Minister Petr Fiala canceled his scheduled events and was heading for Prague.

Sandra Day O’Connor, the first woman to serve on the Supreme Court and who passed away on December 1st at the age of 93, is lying in repose in the court’s Great Hall on Monday. The key figure in landmark cases regarding abortion, affirmative action, and civil rights succumbed to complications of dementia in early December, a diagnosis she announced in 2018.
O’Connor’s casket was carried up the steps in front of the court, which was lined by her former clerks, and passed under the iconic words engraved on the pediment, “Equal Justice Under Law,” before being placed in the court’s Great Hall. A private ceremony was held before the hall opened to the public, allowing people to pay their respects afterward, from 10:30 a.m. to 8 p.m. All nine members of the current court and retired Justice Anthony Kennedy attended the private remembrance.
“The heavens shed a tear this morning,” Justice Sonia Sotomayor said in remarks at the ceremony, calling O’Connor her “life role model.” ❤️
Funeral services for O’Connor are set for Tuesday at Washington National Cathedral, where President Biden and Chief Justice John Roberts are scheduled to speak.

President Joe Biden spoke at the late Supreme Court Justice Sandra Day O’Connor’s funeral on Tuesday at the Washington National Cathedral. The private service brought O’Connor back to the church she attended for years as a Supreme Court justice and to the same place where the nation also held services for former President George H.W. Bush, former Secretary of State Madeleine Albright, and the late Sen. John McCain, R-Arizona.
President Biden praised O’Connor’s ability to “open doors, secure freedoms, and prove that a woman can not only do anything a man can do, but many times do it a hell of a lot better.”
