Hollywood Reporter article 2013: Former SAG President Ed Asner filed a lawsuit targeting 2 top SAG Staffers including Duncan Crabtree-Ireland. “A recent lawsuit filed against SAG-AFTRA by disgruntled members is structured as a direct attack on national executive director David White and chief administrative officer and general counsel Duncan Crabtree-Ireland, according to a copy of the suit obtained by The Hollywood Reporter.” “The instant action was filed because SAG-AFTRA has resisted all efforts to obtain accountability and transparency in Union finances,” the plaintiffs’ attorney Helena Sunny Wise told THR in an email. In that context, White and/or Crabtree-Ireland are portrayed as motivating forces behind an array of alleged improper practices relating to foreign royalties and residuals and are mentioned 49 times in the 52-page page document.” “The thrust of the complaint is that the union has operated its foreign royalties program incompetently and in a manner designed to improperly funnel money into the union’s general fund.” Another claim in the case is similar to the language in this 2023 draft. Claim: “Failure to Locate People who are Allegedly Easy to Locate. The complaint asserts that SAG-AFTRA retains residuals owed to people who are easy to locate: “SAG (sic) leadership, including CRABTREE-IRELAND has sought to justify the burgeoning retention of Residuals on the premise that SAG cannot locate the heirs or estates of such well known entertainment and/or political icons as Frank Sinatra, John F. PART 2 (please see part 1 first) Below are the facts, which we see as irrefutable, and lead us to a NO vote after reading the 129-page draft (Not final contract) released by SAG/AFTRA. “The Producer determines the number of production days that the performer would have been required to work had the performer instead performed those scene(s) in person. The Producer will make a good faith effort to estimate the number of production days.” There are a lot of clauses where the producers will act in “Good Faith.” Another one: “The Producer agrees to give the Union notice and an opportunity to bargain in good faith over appropriate consideration, if any, if a Synthetic Performer is used in place of a performer who would have been engaged under this Agreement in a human role.” This verbiage gives us nothing. Don’t forget these people who will be negotiating in good faith are the people making multi-million-dollar salaries, who said that they were fine with people losing their houses, have lied for years claiming they’ve made no profit and have never showed accounting. (More on profits later.) Even SAG admitted they were played by the Producers with giving them the extension – there was no good faith negotiation. It allowed them to release some of their Blockbuster movies and generate a lot of money. These are the same people paying lots of money to cut down trees, put up barricades to impede strikers and hire expensive PR firms rather than pay actors. But we should trust all these vague clauses will be negotiated in good faith. C) Another concerning element in this draft: “If performer is deceased, the Producer shall obtain the consent of the authorized representative (or the Union, if the deceased performer’s authorized representative cannot be identified or located) who represents the deceased performer’s exclusive rights as determined by applicable law.” Why should the Union have this ability? Are they now acting as an agency? Do they get money for this? I personally do not want SAG to have that power over my likeness / identity/ my work after I die.
PART 4 (please see part 1, 2 & 3 first) “Because of the particularly sensitive nature of the Confidential Viewership Information, the Union agrees to grant access to the Confidential Viewership Information only to a limited number of individuals whose access to the Confidential Viewership Information is essential for the Union’s use of this information, but not to exceed six (6) in number.” – Again, why no transparency? Why is it confidential? Why the need for this info to be given to only 6 people in the union. Who will those 6 people be? “The Union may request that an audit (or other agreed-upon procedure) (hereafter ‘audit’) of the Confidential Viewership Information be conducted by a third party jointly chosen by the related/affiliated SVOD service and the Union solely for the purpose of verifying the accuracy of the information provided by the related/affiliated SVOD Service. The third party must execute a confidentiality agreement approved by the related/affiliated SVOD Service. The Union shall be responsible for bearing all costs and fees associated with any such audit.” -Why should it only fall on the Union? SAG won’t do this very often because it will cost them. If you want the job, you will have to sign. “No consent is required when the use is of the type (e.g., Performer 1’s eyes, Performer 2’s mouth) protected by the First Amendment to the United States Constitution, including but not limited to instances when the First Amendment would protect a use for purposes of comment, criticism, scholarship, satire or parody, or would protect a use in a docudrama, or historical or biographical work.” “In the motion picture for which the performer was employed, consent is not required if photography or soundtrack remains substantially as scripted, performed and/or recorded.” 3) STREAMING PAYMENTS & SUCCESS BONUS Viewing Hours: “Domestic Views = Total Hours Streamed Domestically in 1st 90 Days Total Runtime (in hours)” – Why are we limited to the first 90 days? Why are we not entitled to share in the profits for the duration of the time on the platform / for every view? “The Union (and the Success Bonus Distribution Fund) shall not be entitled to obtain information about the number of domestic subscribers, the hours streamed domestically, the running time or the ‘success metric’ of the High Budget SVOD Program.” -How will we ever be paid if there is no accountability / accurate accounting? “Producer may rely on the determination by the SVOD Service whether the ‘success metric’ has been met for any High Budget SVOD Program.” “The SVOD Service shall determine the number of domestic subscribers.” The union has to request an audit in written notice to the SVOD Service and the Producer to dispute whether a High Budget SVOD Program qualifies for a success bonus. A third party is mutually picked but must execute a confidentiality agreement approved by the SVOD Service. The Union and the SVOD Service shall evenly split the costs and fees associated with any such audit.”- The union won’t do this very often because it will cost them.
