If you’re thinking about it, here are Pros/Cons:
Pros ✅
1️⃣Liability Protection: The primary allure of an LLC is the limited liability protection it offers. Essentially, it can protect your personal assets (like your home, car, and savings) in case of a lawsuit related to the property. If the LLC faces legal action, only the assets owned by the LLC are typically at risk.
2️⃣Tax Flexibility: LLCs enjoy a “pass-through” tax status by default, meaning the entity itself isn’t taxed. Instead, income and losses pass through to the individual owners’ tax returns. This can avoid double taxation. You might have the option to elect corporate tax treatment if that’s more advantageous for your situation. But remember it might also lead to self-employment taxes on rental income, depending on how the LLC is managed and the tax treatment elected.
3️⃣Easier to Work with Investors: Forming an LLC can simplify the process of pooling resources with other investors, providing a clear structure for ownership, profit distribution, and decision-making.
Cons❌
1️⃣Financing Challenges: Securing financing for an LLC can be more difficult than individual financing. Banks might require higher down payments and charge higher interest rates for LLC-owned properties because they perceive them as higher risk.
2️⃣Cost and Complexity: Establishing and maintaining an LLC involves upfront costs (like filing fees) and ongoing expenses (like annual fees and the cost of separate tax filings). The administrative workload can be annoying, given the need to maintain proper records and adhere to state regulations.
3️⃣Transfer Taxes and Fees: In some jurisdictions, transferring property into an LLC might trigger real estate transfer taxes, in addition to potential fees. This can add to the cost of setting up your investment structure.
